SERIOUS THREATS OF VIOLENCE PROMPTED POLICE TO DOUSE WATER ON UNRULY MOB The police officer who ordered the spraying of jets water on protesters who tried to force their way through the doorsteps of Malacañang did not err in his “judgment call”. The Manila Police District today concluded its investigation into the circumstances surrounding the October 14 incident in Manila where police used a water hose from a firetruck to ward-off unruly protesters who joined the group of prominent political and religious personalities. In his report to PNP Chief, Director General Arturo C Lomibao, Chief Superintendent Pedro E Bulaong, District Director of the Manila Police District, said the situation posed “serious threats of violence” that prompted the Deputy Ground Commander, Superintendent Florencio Ortilla to signal the firemen to release water from the fire hose. Bulaong cited an investigation report submitted by the Chief of the General Assignment Section, Superintendent Arturo Paglinawan, who conducted an investigation into the incident. A review of video footages taken by a police camera showed some persons among the group of marchers who were carrying guns and bladed weapons. Lomibao has ordered a separate investigation to identify these armed protesters and establish their participation in the violence. According to the MPD investigation, the marchers from Plaza Miranda had earlier confided to police negotiators that they will disperse themselves voluntarily after leaving the San Sebastian Church. At around 7:00 PM, Bulaong said, the marchers left San Sebastian Church and walked towards Lepanto Street. However, a breakaway group suddenly emerged through Plaza del Carmen going to Mendiola St. but where blocked by members of the District Mobile Force Unit (DMFU) forcing the group to head back and join the main body along San Sebastian Street. A “serious commotion and chaotic confrontation” later ensued when the frontline marchers suddenly “rushed ahead” and forced their way to overrun the line of policemen positioned along San Sebastian St. near CM Racto Ave., Bulaong said. The Ground Commander, Superintendent Bernardo Diaz attempted to pacify the mob and tried in vain to reach their leaders. It was at this point when Supt. Ortilla observed the determination of the mob to engage DMFU in a violent confrontation that may escalate into a worse scenario. As the mob came in close body contact with DMFU personnel, Ortilla signaled the firetruck crew to release water from the hose. Bulaong maintained that the protesters were “committing an illegal act in violation of Batas Pambansa 880 when they held a public assembly in a place that is not stated in their rally permit.” He cited Section 10 of BP 880 in justifying the use of jets of water on the mob to prevent “actual violence or serious threats of violence”.
