Generally, the clearances issued are not only limited/confined to civilians but are also intended for other purposes, among others are the following:
ORGANIZATIONAL BACKGROUND The earliest law that specifically mentions the requirement for police clearance is Republic Act No. 1204, which was promulgated on April 20, 1955. This was an amendment to Act No. 3992 which specifically states that no person shall be issued a professional driver's license unless it has first obtained a police clearance. Letter of Instruction No.130 which states the implementing guidelines of Presidential Decree No. 298, both dated September 19, 1973, also mentions the requirement for police clearance for Chinese nationals who are applying for immigration to our country. So does Republic Act No. 8043 dated June 7, 1995, which states the requirement for police clearance for inter-country applicant(s) adopting a Filipino child. These latter laws, however, are referring to police clearances issued by other countries. The requirement for police clearance for firearms and explosives authorizations as well as private security agency business and job opportunities are borne out of the PNP's function of regulating these activities. No specific mention of the requirement for police clearance was stated in the laws governing said activities. The basic procedure for determining the issuance of police clearance has not changed with the passing of time. A search is made from the police files, and if the applicant has no matching record, then he will be issued a police clearance. The storage of files may have changed-from manual to computer-based, but the basic premise remains the same. Presently, the Counterintelligence and Security Division (CSD) are handling the issuance of police clearance, which are under the Directorate for Intelligence. THE EXISTING SYSTEM A. OBJECTIVES OF THE EXISTING SYSTEM General Objective PNP DI Clearance System aims to assist the Philippine National Police (PNP), in providing better service to the public by means of an efficient and reliable system that will process the issuance of clearance. The existing Police Clearance System was an interim system established to modernize the previous manual process. It also intended to provide a better record check of applicants, whether civilians, police or military, government employee or official, who apply for a clearance in compliance with laws and requirement of agencies, private or government, for purposes such as employment, travel abroad, or naturalization. This requirement is also in line with the PNP's function of regulating the operations of private security agencies as well as the manufacture, sale, repair and license to possess and carry firearms. Other Purpose The PNP DI clearance is different from the local police clearance issued by PNP line units such as the Municipal Police Station, City Police Station and City Police Office. The former is under the direct control of NHQ PNP through the Directorate for Intelligence. The funds generated from said clearance go directly to the PNP Trust Fund handled and managed by the organization. On the other hand, the local police clearance is being handled and managed by the LGU concerned. Local police clearance generally required from civilians seeking local employment. B. Procedures involved in applying for a police clearance: 1. Filling-up of application form and payment slip. Applicants are given clearance application forms free of charge and proceed to Window 1. This form must be filled-up and accomplished by the applicant together with his latest Community Tax Certificate, and the applicant must affix his/her thumbprint and signature. 2. Payment of application fee Upon completion of the application form, the applicant must pay at Window 2 (PNP 14th FinanceService Annex) the amount of P80.00 as application fee, for the purpose of the PNP Clearance. The applicant will then be issued an official Receipt as proof of payment of the Police Clearance application. 3. Validation of application form. The applicant will then submit his accomplished application form together with the Official Receipt at Window 3 for validation of the application form. The accomplished application form will then be examined/validated by personnel of CSD. If the validating CSD personnel find his application in order, the applicant will be advised to wait for the release of his clearance at Window 4, otherwise, the applicant will be informed of any wrong or lacking information in his application form. 4. Processing of Clearance Application The validated application form with the applicants Photo, Information of his community tax certificate, and thumbprint will be encoded into the existing PCS by assigned Clearance Section personnel. Basic information such as name, address, birth date and birthplace sex, and status of applicant will be added in the applicant's master file. The applicant's names is then searched in the file of person with derogatory records, in the Personal Clearance System formerly known as the Personality Monitoring System (PMS) and OB information System of the Intelligence Research Center (IRC) which is being encoded and updated daily by IRC personnel. If no match is found, the applicant will be issued a Police clearance, otherwise, issuance of his clearance will be withheld pending the adjudication procedure that will be administered to him by the CSD. The adjudication process of the CSD requires manual record check and retrieval on existing intelligence folders and background investigation. If the process yields negative result, a clearance will then be issued, otherwise, the applicant will be denied of such. 5. Printing of Police Clearance Certificates Once the clearance has been processed and documented, the requested Police Clearance Certificates filed by the applicants will then be printed within the day. 6. Release of Clearance Certificates All printed police clearances will be counter-checked by CSD authorized personnel and have it signed by the Director for Intelligence or his authorized representative. It will be dry-sealed and the certified police clearances will be forwarded to the releasing Window 4 for issuance. The pooled clearance certificates are release within 10 minutes from the filing of his/her filled application form and payment of clearance fee. 7. Generation of Periodic and Ad Hoc Reports The Police Clearance Section of the CSD is responsible for submitting Accomplishment Report on a daily, weekly, monthly, quarterly, and yearly basis.
